Terms of use of the www.prestigeandtime.com website

The website is operated by Prestige and Time. The User undertakes not to use the Prestigeandtime.com website or any of its contents for purposes contrary to the law, public order or these General Terms and Conditions of Use. As such, the User is prohibited from:

a) use the site for illegal or fraudulent purposes; (b) to incite third parties to commit or participate in illegal acts; c) to contravene any applicable legislative or regulatory provision, whether local, national or international; d) infringe the intellectual property rights of Prestige & Time or any third party; e) Through comments, harass, threaten, abuse, defame, slander, discredit, intimidate or discriminate against any person, including on the basis of gender, sexual orientation, religion, ethnicity, race, age, nationality or disability; (f) provide false, misleading or deceptive information; g) upload, transmit or introduce any virus, malicious code or device that may alter or interrupt the operation of the website, the Service, a third-party website or the Internet; (h) collect, store, monitor or otherwise exploit the personal data of others without express permission; i) to carry out mass and unsolicited communications ("spamming"), phishing, fraud, domain hijacking, or any attempt at extortion or computer intrusion; j) to use the website or its content for purposes contrary to good morals or ethics; k) attempt to circumvent, disable or disrupt the security measures implemented on the Site or any linked third-party site.

Prestige & Time reserves the right to suspend or terminate, without notice, any User's access to the site and its Services in the event of a violation of these prohibitions.

 

1. General Terms and Conditions of Sale (GTCS)

·       Scope and acceptance

These General Terms and Conditions of Sale (GTCS) govern all sales concluded between Prestige & Time and its customers. Any order implies full and complete acceptance of these T&Cs, which take precedence over any other contradictory document.

 

·       Price and payment

The prices of the products are indicated in euros, all taxes included, excluding any processing and delivery costs. The products remain the property of Prestige & Time until full payment of the price. Payment can be made by credit card or bank transfer. Any delay in payment will result in legal penalties and possible suspension of the order.

·       Ordering and validation

Orders are placed via the www.prestigeandtime.fr website. The order confirmation sent to the customer is proof of the contract. Prestige & Time reserves the right to cancel any order in the event of a previous dispute or payment problem.

·       Availability and delivery

Offers are valid while stocks last. In case of unavailability, the customer will be informed quickly and will be able to obtain a refund. The products are delivered to the address indicated by the customer, within an average of 7 working days in metropolitan France. In the event of a delay of more than 7 working days compared to the scheduled date, the customer may cancel his order and be refunded.

·       Right of withdrawal and returns

In accordance with the regulations, the customer has a period of 14 days to exercise their right of withdrawal from the date of receipt of the product. Products must be returned complete, unworn or used, in their original packaging and accompanied by the invoice. Return shipping costs are the responsibility of the customer, except in the event of non-conformity or defect in the product.

·       Compliance and warranty

Prestige & Time is committed to delivering a product that complies with its design.

Prestige & Time is committed to selling only authentic watches that are controlled by our watch experts.
Each watch offered for sale is subject to a rigorous verification of its origin, its components and its compliance with the standards of the watchmaking houses concerned.

All pre-owned watches sold by Prestige & Time benefit from a 12-month commercial warranty, which is in addition to the legal guarantees of conformity and against hidden defects provided for by the Consumer Code and the Civil Code.

New watches are covered only by the manufacturer's warranty.
Warranty exclusions:- Theft or loss of the watch;- Normal wear and tear (bracelet, glass, battery, crown, pushers, case);- Damage related to an accident, shock, mishandling, lack of maintenance or improper immersion (water and other fluids);- Repairs or interventions carried out by an unauthorised third party;- Modification or replacement of parts with unofficial components (which may compromise reliability,  , waterproofing and performance).

The warranty is non-transferable and remains exclusively with the original purchaser.

In the event of a malfunction, the customer can return the watch for an appraisal. If the problem is covered by the warranty, the repair will be carried out at no cost. The cost of transport to the workshops remains at the expense of the customer, unless otherwise agreed.

If a customer has serious reasons to doubt the authenticity of the watch purchased on the Prestige & Time website, he must:

1. Notify Prestige & Time in writing (email or registered mail) within 30 days of the discovery of the doubt;
2. Provide all the elements justifying their suspicion (watchmaking expert report, detailed photos, official documents, etc.);
3. Return the watch to Prestige & Time in its original condition at the time of purchase, along with all documents and accessories received at the time of purchase.

Upon receipt of the product, Prestige & Time mandates an independent watchmaking expert to carry out an adversarial appraisal.

If the expert report concludes that there has been an infringement, Prestige & Time will immediately refund the full amount paid by the customer, including the original return and delivery costs.

If the expert opinion confirms the authenticity of the watch, it is returned to the customer at his expense.

·       Liability and force majeure

Prestige & Time cannot be held responsible in the event of force majeure or events attributable to the customer. The photos and visuals of the products are illustrative and have no contractual value.

·       Intellectual property

All content on the site (texts, images, logos, etc.) is protected by intellectual property rights. Any reproduction, in whole or in part, is prohibited without prior written permission.

·       Personal data

The information collected is processed in accordance with current legislation and used only for order management and communication with the customer. Prestige & Time undertakes not to disclose personal data to third parties without consent.

·       Applicable law and disputes

These T&Cs are governed by French law. Any dispute will be brought before the competent courts in the jurisdiction of Prestige & Time's registered office.
